#Cuba UN GRITO INTERNACIONAL EN APOYO A ARTISTAS CONTRA EL 349

UNA LLAMADA GLOBAL: NO AL DECRETO 349
El gobierno cubano quiere implementar una normativa –comúnmente conocida como Decreto 349- para someter a la estricta tutela del Estado toda actividad artística y creativa en la isla. El contenido del decreto puede resumirse en dos premisas clásicas de cualquier Estado totalitario: Sometimiento del artista a una autorización previa del ejercicio de su métier y la censura en cualquier instancia del proceso creador.
La ejecución de estas dos premisas se deja a cargo de un intrincado entramado de funcionarios públicos, contribuyendo de esta manera a una amplia discrecionalidad y al reforzamiento del tan mentado “burocratismo” que puebla el lenguaje de la autocrítica revolucionaria.
El título mismo del decreto ya refleja la particular visión que tiene el gobierno cubano con respecto al arte, ya que se refiere a la “prestación de servicios artísticos”. Si la función del arte es prestar un servicio, pues que se lo preste al propio régimen y a nadie más.
El arte como artefacto utilitario no sólo contraviene la Declaración Universal de los Derechos Humanos (Cuba es miembro activo de la Organización de Naciones Unidas), sino también los principios básicos de la Organización de Naciones Unidas para la Educación, la Ciencia y la Cultura (UNESCO).
No es que el decreto incluya algo novedoso a la práctica corriente del gobierno cubano en la gestión de la ingeniería social de su población, pero blinda legalmente una práctica reaccionaria, vetusta y regresiva incluso en el campo de los que se consideran progresistas. Nadie niega el logro extraordinario de Cuba en términos de satisfacer las necesidades básicas de todos sus ciudadanos, especialmente la provisión de salud y educación, pese a todas las adversidades impuestas, por más de cincuenta años, por el bloqueo político y económico de la nación más poderosa del mundo. En ese contexto, todos los creadores cubanos no solo eran libres de practicar el arte, sino que eran promovidos por el Estado y eran el símbolo de una solidaridad global.
En el fondo, la libertad inherente al acto creativo es algo que un gobierno cuyo objetivo revolucionario es permanecer en el poder no puede tolerar. Seguro lo van a aprobar, pero pronto se darán cuenta que el desierto creativo que será la secuela inmediata de la implementación del decreto los aburrirá incluso a ellos mismos. La nomenclatura viviendo en su confort material, buscarán ver películas de Hollywood, en lugar de escuchar su propia propaganda.
La libertad de creación, una expresión básica humana, se está convirtiendo en una situación “problemática” para muchos gobiernos en el mundo. La reacción de dichos gobiernos es la degradación de los derechos fundamentales que se evidencia no solo en la injusta detención de creadores de reconocimiento internacional, sino que, principalmente, arremete contra todos los derechos fundamentales de todo creador. Su estrategia, basada en la construcción de una estructura legal, limita derechos humanos fundamentales básicos que son inalienables, como son la libertad de expresión. Este problema acontece hoy a una escala global y debe preocuparnos a todos.

A GLOBAL CALL: NO TO DECREE 349
The Cuban government intends to implement a regulation –commonly known as Decree 349- which will subdue artistic and creative activity on the island, bringing it under the State’s strict tutelage. The content of the Decree comprises two classical premises of any totalitarian state: The need for the artist to obtain prior authorisation for the exercise of his/her work and censorship of the creative process.
The execution of these two premises is to be overseen by an intricate structure of civil servants, subject to their discretion, thus reinforcing a “bureaucracy” which inhabits the language of revolutionary self-criticism.
The title of the Decree reflects the particular vision that the Cuban government has about Art, because it refers to “the provision of artistic services”. If the purpose of Art is to provide a service, then it essentially provides only to the Regime and to no one else.
Art as a utilitarian artifact not only contravenes the Universal Declaration of Human Rights (Cuba is an active member of the United Nations Organisation), but also the basic principles of the United Nations for Education, Science and Culture (UNESCO).
The decree does not include anything new to the current practice of the Cuban government in the management of social engineering of its population, however it offers a legal cover to a reactionary, ancient and regressive practice even in the field of those who consider themselves progressive. Nobody can deny the extraordinary achievement of Cuba in terms of providing basic necessities to its citizens, particularly provisions of health and education; this in spite of a setback of over fifty years, resulting from a political and economic embargo from the world’s most powerful nation. Under these conditions, creatives in Cuba were not only free to practice art but were actively promoted by the State and became a symbol of a global solidarity.
Ultimately, freedom that is inherent to creative acts is something that a government whose only objective it is to remain in power, will be unable to tolerate. In adopting the act and implementing the decree, they will find themselves in a creative desert that will bore even themselves. The nomenclature living in their material comfort, will seek to see Hollywood movies, instead of listening to their own propaganda.
Freedom of creation, a basic human expression, is becoming a "problematic" issue for many governments in the world. A degradation of fundamental rights is evident not only in the unfair detention of internationally recognised creatives, but, mainly, in attacking the fundamental rights of every single creator. Their strategy, based on the construction of a legal framework, constrains basic fundamental human rights that are inalienable such as the freedom of speech. This problem occurs today on a global scale and should concern us all.

Por el momento hay mas de 70 impresiones y siguen. El Turbine Hall se vestirá en pocas horas contra un decreto que convierte una expresión básica como el acto de crear, en un problema legal. Hoy los participantes en esta manifestación pacífica (que en Cuba sería motivo de detenciones arbitrarias y de que los involucrados al momento pasen de ser ciudadanos con derechos a contrarrevolucionarios) se solidarizan con todos los artistas en Cuba que a 48 horas de la implementación de este Decreto continúan esperando una respuesta, un diálogo.

La directora del Tate Modern se solidariza con cada uno de los artistas que están intentando un diálogo en favor del arte libre y que en estos momentos se encuentran detenidos porque las instituciones culturales de #Cuba no están abiertas a una conversación respetuosa con sus artistas y están simplemente matando el tiempo hasta el día 7 de diciembre que implementarán el #Decreto349.
